myPLACE Rewards ("the Program") is sponsored by The Children's Place, Inc. ("the Company"). You may become a member of myPLACE Rewards ("Membership") free of charge if you are a legal resident of the United States (including Puerto Rico) or Canada and have reached the age of majority in your jurisdiction of residence.
To establish your Membership, you need to provide your first and last name, a valid email address and phone number. Program communications, offers, and rewards will be sent via email; therefore, a valid email address is required for membership. If you wish to receive communications and rewards via text, you will need to opt in and provide permission in your online member profile (standard message and data rates may apply). You also need to provide your zip or postal code and your phone number so that we are able to look up your account if you do not have your Membership number. You are responsible for providing any changes or updates to your contact information.
You may have only one account. Two members may share an account if they are legal residents of the same household. Account sharing will be permitted if a requesting member provides reasonable proof that he/she legally shares a household with another member.
Residents of Canada: Points can only be earned and reward certificates can only be redeemed on purchases made at The Children's Place and The Children's Place Outlet stores located in the United States and Puerto Rico, and at childrensplace.com if shipped to a street address or PO box in the United States.
By enrolling in the Program, you are confirming that you are the age of majority in your jurisdiction of residence, accepting these terms and conditions and giving the Company the right to use your transactional and profile data to send personalized program communications and special offers to the email address or mobile phone number provided during enrollment.
You are responsible for remaining knowledgeable about the Program terms. The terms published in the myPLACE Rewards section of The Children's Place website (myplacerewards.com) will be the applicable terms for the Program. The most current online version of these terms will supersede all previous versions of these terms.
Unless prohibited under the applicable laws of your jurisdiction, such as Quebec, The Children's Place reserves the right to terminate or change myPLACE Rewards, or any portion thereof, at any time, without prior written or electronic notice. Regardless of how you participate in the Program, benefits can be changed or terminated at any time without notice at the sole discretion of The Children's Place. If you do not agree with the revised terms, you may cancel your Membership. For details on how to cancel your Membership, see below.
The program is void where prohibited by law.
When you present a valid account identifier such as your member number, phone number or email address from your member profile, you earn points on the eligible purchase amount at the rate of 5 points per US dollar spent, rounded to the nearest dollar. The eligible purchase amount is the transaction total for merchandise and gift wrap service after any discounts and does NOT include taxes, shipping or purchases of gift cards.
Transactions that can earn points ("eligible transactions") include all of your purchases of merchandise and gift wrap service at The Children's Place and The Children's Place Outlet stores located in the United States and Puerto Rico and at childrensplace.com (excluding merchandise shipped outside the United States). A transaction may earn points for only one account.
Bonus points may be earned on certain purchases or non-purchase activities as defined by the Company from time to time. The Company reserves the right to limit promotional offers for bonus points to selected members and to terminate bonus point offers at any time.
Points cannot be earned or claimed on purchases made prior to your enrollment date. Bonus points cannot be earned prior to the start date of any bonus promotions associated with the Program.
Points have no cash or other monetary value, are not transferable and may not be sold, resold, exchanged or bartered. Points are issued into your account approximately 7 days after the date of the eligible transaction unless otherwise noted on the terms of a bonus offer.
If points are not issued for an eligible transaction, you may request the missing points up to 90 days after the original transaction at myplacerewards.com. You will be asked to provide certain transaction-related information on the receipt to verify the purchase. All requests are subject to verification. The Company's decision as to whether or not points will be earned is final.
Unused points will expire at the end of the calendar quarter one year after they are earned. For example, points earned in October 2012, November 2012 or December 2012 will expire at the end of December 2013.
The Company may adjust your account status or points balance at any time and without notice, due to any computer or other error, technical issues experienced by the Company, machine malfunction, fraud or other misuse of membership.
All transactions involving points are subject to review and verification by the Company.
Points or rewards you earn or are awarded may be subject to taxation, for which you are solely responsible. The Company will not be responsible for any tax consequences which may flow from your Membership.

You are eligible for reward certificates as follows:
The Company may issue reward certificates to you when you become eligible for a reward certificate. In addition, you may convert points into rewards certificates by accessing your account online at myplacerewards.com. From your member account, you can print the rewards certificate or apply it to an online purchase. You may have no more than $20 USD in rewards certificates outstanding at any given time; an outstanding rewards certificate is one that has been issued but has not yet expired or been redeemed (used toward merchandise or gift wrap at The Children's Place, The Children's Place Outlet stores, or childrensplace.com orders shipped to a street address or PO box in the U.S.). If your request to convert points into a rewards certificate would exceed the $20 USD outstanding limit, the conversion will not be permitted until you have used another outstanding rewards certificate or a rewards certificate expires.
You may convert up to 20,000 points during a calendar month. If your request to convert points into a rewards certificate would exceed the limit of 20,000 points, the conversion will not be permitted. Once points are redeemed for a reward, the points cannot be deposited back into your member account.
You may combine more than one rewards certificate as long as they are all from the same myPLACE Rewards member account. You may also combine rewards certificates with The PLACE credit card 5% discount (PLACE credit card not valid for residents of Canada) and one promotional offer unless otherwise noted on the offer. You may also use rewards certificates on a transaction where you are using a merchandise credit. myPLACE Rewards Certificates and/or other $ off coupons/offers will be applied prior to any % off coupons/offers.
Occasionally, there may be bonus rewards certificates offered on a promotional basis, which will not count toward your outstanding balance for rewards certificates; however, you will be able to redeem no more than $20 USD per day using both rewards certificates and bonus rewards certificates.
No cash or credit or refund will be given for the unused portion if a rewards certificate exceeds the amount of the purchase.
You may use your rewards certificate toward the purchase of merchandise or gift wrap at The Children's Place and The Children's Place Outlet stores in the United States and Puerto Rico, as well as childrensplace.com (excluding merchandise shipped outside of the United States). You will be able to use rewards certificates on any merchandise for sale including marked down and clearance items. You will not be able to use rewards certificates for tax, shipping or the purchase of gift cards. You may be responsible for taxes, shipping fees or any other fees applicable to rewards certificate redemption.
Each rewards certificate issued will have a unique reward number and may be used only once. You will need to provide a printout of the rewards certificate or the reward number at the time of purchase in order to redeem a rewards certificate, which may be done by using the reward number stored in your member account (online at childrensplace.com).
Rewards certificates expire 30 days after they are issued.
Any points you earn on a purchase are deducted from your account if you return the merchandise. When merchandise is returned from a transaction where a rewards certificate was used, the amount refunded will be the purchase price of the item(s) less a prorated amount of the rewards certificate that was applied. Once a rewards certificate has been used in a transaction it cannot be reissued or used again.
Members with $250 USD or more in eligible purchases associated with their member number during a calendar year will be designated as Gold members for the remainder of that year and the following calendar year. As an example, if you qualify for Gold status in August 2013, you will retain your status until December 31, 2014 as long as your end-of-year eligible purchases were over $250 USD at the end of 2013.
The dollar amount from returned merchandise will decrease the purchases that are applied toward tier status. If a return decreases the amount of purchases below $250 USD during a calendar year, your Gold status will be re-evaluated and you may no longer have Gold status.
Gold members will earn 1 extra bonus point per dollar spent on eligible purchases for a total of 6 points per dollar. Gold members may receive additional benefits as defined by the Company from time to time.
At its discretion, the Company may offer additional benefits to certain members based on their purchases and/or other activities.
You must provide and maintain accurate and current user information in connection with your membership, including name, email address and telephone number. You can update your account information at myplacerewards.com.
You have the right to cancel membership at any time by calling Customer Service: U.S. customers at 877-752-2387, Canadian customers at 877-827-7895. If you cancel your membership, your account will be closed, your points balance will be zero and you will no longer have membership benefits. The Company, in its sole discretion, may terminate your membership without notice if continued use of your membership would violate any terms. For example, if the Company has valid reason to believe your account is being used fraudulently, membership will be terminated. If your membership is terminated, your account will be closed, your points balance will be zero and you will no longer have membership benefits.
Unless the applicable laws of your jurisdiction require that the laws of such jurisdiction govern, such as Quebec, all issues and questions concerning the construction, validity, interpretation and enforceability of these terms shall be governed by and construed under the laws of New Jersey, U.S.A. without reference to conflict of law provisions.
United States and Puerto Rico: Any and all controversies, disputes, demands, counts, claims, or causes of action (including the interpretation and scope of this clause, and the arbitrability of the controversy, dispute, demand, counts, claim, or cause of action) between you and the Company or the Company's employees, agents, successors, or assigns, shall exclusively be settled through binding and confidential arbitration, except that you or the Company may take claims to small claims court if the dispute qualifies for hearing by such a court. There is no judge or jury in arbitration and arbitration procedures are simpler and more limited than rules applicable in court, and review BY A COURT is limited.
Arbitration shall be subject to the U.S. Federal Arbitration Act and shall be conducted before the American Arbitration Association ("AAA"). Information on AAA and how to start arbitration can be found at http://www.adr.org or by calling 800-778-7879. As modified by this agreement, the conduct of the arbitration shall be subject to AAA's then-current rules for commercial arbitration and, if the arbitrator deems it appropriate, consumer disputes.
You and the Company must abide by these rules: (a) the arbitration shall be conducted on an individual basis and not in a class, consolidated or representative action and the arbitrator shall not award class-wide relief; (b) the Company will pay the arbitration costs as required by AAA's rules, and in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to costs of litigation, TCP will pay as much of your arbitration filing and hearing fees as the arbitrator deems is necessary to prevent the arbitration from being cost-prohibitive as compared to the cost of litigation; (c) the arbitrator may award any individual relief or individual remedies that are permitted by applicable law; and (d) each side pays his, her or its own attorneys' fees and costs unless the claim(s) at issue permit the prevailing party to be paid its fees and litigation costs, and in such instance, the fees and costs awarded shall be determined by the applicable law.
With the exception of subpart (a) in the paragraph above, if any part of this arbitration provision is deemed invalid, unenforceable or illegal, then the balance of this arbitration provision shall remain in effect and be construed in accordance with its terms as if the invalid, unenforceable, or illegal provision were not contained. If, however, subpart (a) in the paragraph above is found invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void. If for any reason a claim proceeds in court rather than in arbitration, the dispute shall be exclusively brought in state or U.S. federal court in New Jersey.
Canada: After any dispute arises, the parties involved in the dispute may agree to resolve the dispute using Arbitration. If the parties elect to use arbitration, disputes shall be referred to ADR Institute of Canada.
